The Ministry of Defence informs you that access to and use of the website www.mde.es and all of its sub-domains and directories included within the same (henceforth, jointly designated the Portal), as well as the services or contents that may be obtained through the same, are subject to the terms detailed in this Legal Warning, without prejudice to the fact that access to some of these services or contents may require the acceptance of additional General Conditions.

Therefore, if you do not agree with the considerations detailed in this Legal Warning, we ask that you do not make use of the Portal, since any use that is made of the same or of the services and contents included in it imply the acceptance of the legal terms compiled in this text.

The Ministry of Defence reserves the right to make changes in the Portal without previous notice, to the end of up-dating, correcting, modifying, adding or eliminating contents of the Portal or its design. The contents and services that the Portal offers are up-dated periodically. Due to the fact that information up-date is not immediate, we suggest that you always check the validity and accuracy of the information, services and contents included on the Portal.

Both the Portal design and its font codes, as well as the logos, marks, trademarks and other distinctive symbols that appear on the same, belong to the Ministry of Defence or collaborating organisations and are protected by the corresponding copyrights and patent rights. Likewise the images, etcetera contained on the Ministry of Defence's server are protected by the corresponding copyrights and patents.

Their use, reproduction, distribution, public communication, transformation or any other similar or analogous activity is totally forbidden without express authorisation from the Ministry of Defence. The licence to use any content on this Portal granted to the user is limited to the download by the user of this content and the private use of the same, provided that the aforementioned contents remain in their entirety.

SOCIAL NETWORKS

The Spanish Army Department of Communication (DECET, in Spanish) is the solely responsible of the management and control of the Spanish Army Social Networks' official profiles. This responsability encompasses, among other things:

  • Preparing and creating all the governing regulations of the presence and scope of the Spanish Army within the Social Networks.
  • Authorizing different Spanish Army's Units, Centers or Bodies to create Social Networks accounts laying down the operating conditions of such accounts.
  • Blocking those users who make abusive and offensive content; primarily those against:
    • The Constitution of Spain.
    • The Spanish Governmental Institutions.
    • The International Organizations of which Spain is a member.
    • The Spanish Army and all the Spanish Armed Forces (FAS, in Spanish).
    • The Armed Forces belonging to countries that are friends/allied of Spain.
    • The State of Spain security forces and bodies.
    • State Authorities.

 

 

PRIVACY

The Ministry of Defence is the organisation in charge of the data file generated with the data of a personal nature supplied by the users of the portal www.mde.es.

In accordance with the Constitutional Law, "Ley Orgánica", 15/1999 of 13th December on the Protection of Data of a Personal Nature, the Ministry of Defence is committed to fulfilling its obligation of secrecy regarding the data of a personal nature and its duty to treat them with confidentiality. For this purpose, the necessary measures will be adopted to avoid their alteration, loss, processing or unauthorised access.

Data capture and automated processing of personal data has the aim of the management, service, expansion and improvement of the services requested at each moment by the user and the monitoring of the enquiries made by users.

You will have the possibility to exercise the rights of access, rectification, cancellation and opposition of your personal data in the Ministry of Defence's files by requesting the same by any means that registers and provides a receipt of its submission and reception. The Ministry of Defence maintains personal data protection levels in accordance with Royal Decree 994/1999, of 11th June, regarding security measures of automated files containing data of a personal nature, and has established all the technical measures available to avoid loss, misuse, alteration, unauthorised access and theft of the data that you provide the Ministry of Defence with, without prejudice to the fact that Internet security measures are not impregnable.

The Ministry of Defence reserves the right to modify the present Privacy Policy in order to adapt it to legislative or jurisprudential changes, or those in interpretation by the Spanish Agency on Data Protection. In this case, the Ministry of Defence will announce these changes and clearly indicate the modifications carried out with due advance notice and request, when necessary, your acceptance of these changes.

 

 

APPLICABLE LAW AND JURISDICTION

The applicable law in case of dispute or conflict regarding the interpretation of the terms that make up this Legal Warning, as well as any question related with the services of the present Portal, will be Spanish law.p>

For the resolution of any conflict that could arise on the occasion of visiting the Portal or from using the services that are offered on it, the Ministry of Defence and the User agree to submit to the Judges and Courts of the User's locality, provided that this is situated in Spanish territory.
